Text Communication Programs
View the terms and conditions for receiving text communications from MBUSA, plus information on how to activate or stop such alerts.
MBUSA provides certain services through recurring SMS text communication through MBUSA News & Announcements, MBUSA Vehicle Alerts, and MBUSA Polls and Surveys (collectively “Text Communication Programs”). By confirming your mobile phone number(s) and successfully activating any of the Text Communication Programs, (i) you acknowledge and represent that you are the authorized user of the mobile phone(s) that you subscribe to the text communication service or have been granted permission by the authorized user of the mobile phone(s) to enroll such mobile phone(s) in the service; (ii) you grant MBUSA express permission to send text communications to the registered mobile phone(s) through your wireless phone carrier unless and until such permission is revoked in accordance with these terms and conditions; and (iii) by granting such permission to MBUSA you are hereby requesting to receive such text communications in spite of the fact that your number may otherwise be on the federal, or a state's, Do Not Call List and you agree, to the maximum extent permitted by law, that such text communications shall not be in violation of such Do Not Call List(s).
Opt In to Text Communications:
To activate MBUSA Text Communication Programs, select “Yes” for the question “Mercedes-Benz USA is now offering communication via text messages. Would you like to receive communication via text?” within the MBUSA survey regarding your most recent sales or service experience. After submitting your survey, you will receive a confirmation text message at the mobile number we have on file or the number you provide.
You will be asked to verify your mobile phone number before the service will start. Reply “Yes” to opt in to SMS messaging. You may receive up to 5 personalized text communications per month per program. By signing up for any of the Text Communication Programs, you agree to these Text Communication Terms and Conditions. There is no charge from MBUSA for Text Communication Programs, but YOUR SERVICE PROVIDER’S MESSAGE AND DATA RATES MAY APPLY. You are solely responsible for all message and data charges that you incur. Please contact your mobile service provider about such charges. You acknowledge that text communications may be sent using an automatic telephone dialing system. You acknowledge and understand that text communications are sent without encryption, which presents some security risk.
Stop Text Communication: You may opt out of MBUSA’s Text Communication Programs at any time. To stop receiving text communications from MBUSA, text “STOP” to the number from which you are receiving MBUSA text communications. Your text should contain only the word “STOP” without any additional words, spaces, or characters either before or after the word “STOP.” MBUSA will reasonably endeavor to comply with other text communications in which you indicate a clear and unmistakable intent to revoke your prior permission; however, you (a) understand that these text communications go to a number that is entirely automated, is not monitored by a human, and the ability of our message inbox to interpret your intent is severely restricted and, therefore, (b) you hereby release MBUSA from any liability for your efforts to revoke your permission via a text message that does not strictly comply with the terms stated above. After you submit a request to unsubscribe, you will receive one final text message from MBUSA confirming that you will no longer receive text communication from the applicable Text Communication Program. No additional text communication will be sent unless you re-activate your enrollment to the Text Communication Program. You agree that your prior express consent to receive text communication shall continue indefinitely unless and until you cancel your prior express consent.

Message Frequency: Message frequency will depend on the Text Communication Program(s) you activate.

No Warranties: MBUSA makes no representations or warranties whatsoever regarding the Text Communication Programs. MBUSA hereby disclaims all warranties, including any implied representations or warranties of merchantability or fitness for a particular purpose. The Text Communication Programs are offered on an “as is” basis and: (1) may not be available in all areas at all times; and (2) may not continue to work in the event of product, software, coverage or other service changes made by your wireless carrier. MBUSA may change or discontinue any of its Text Communication Programs without notice or liability to you. MBUSA and its related companies and each of their respective officers, directors and employees are not responsible and shall not be liable for any losses or injuries of any kind resulting, directly or indirectly, from any Text Communication Program or from technical failures or delays of any kind. MBUSA reserves the right to cease delivery of text communication to any person at any time in its sole discretion.
Limitation of Liability: To the maximum extent permitted by applicable law, you hereby agree that MBUSA shall not be liable for any direct, indirect, consequential, special, incidental, punitive, or any other damages relating to your use or receipt of or failure to receive text communication. Furthermore, MBUSA and the mobile carriers (including T-Mobile) are not liable for delayed or undelivered text communications.
Indemnity: To the maximum extent permitted by applicable law, you hereby agree to indemnify and hold harmless MBUSA, its subsidiaries, affiliates, officers, agents, employees, partners, and licensors from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use or receipt of or failure to receive MBUSA’s text communication.
Governing Law; Enforceability: These terms shall be construed in accordance with the laws of the State of Georgia, and any arbitration or judicial proceedings to enforce or interpret the terms hereof may be brought only in the State of Georgia. If any part of these Text Communication Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Text Communication Terms and Conditions, and the remaining portions shall remain in full force and effect.

Your continued use and acceptance of text communications after changes are posted will mean that you accept the terms as modified by the posted changes.
