1.1 Information You Provide to Us
You may provide us with information in various ways:
Account Registration
- When you register for an account on our website and software applications (collectively, the “MBUSA Platform”), you must provide certain information like your name and email address
- You may optionally provide additional information such as physical address and phone number
- Accounts may store vehicle information, shopping and service history, preferences, and program participation
Business customers may also be required to register an account to access certain Mercedes-Benz products, services, and business applications. In such situations, you may be asked for contact details and payment information.
Orders and Vehicle Reservations
- When placing an order or vehicle reservation, you must provide information necessary to fulfill that request, including name, address, phone number, and payment information
Inquiries and Customer Support
- When submitting inquiries through our contact forms, you must provide information such as your name, email address, and, in some instances, phone number
- For financing inquiries, we may also collect date of birth, social security number, and employment information
- When contacting customer support, you may be requested to provide your name, contact information, location, and vehicle details
- Calls to our support centers may be recorded for quality assurance purposes
Sweepstakes, Promotions, and Surveys
- When participating in sweepstakes, surveys, and promotional activities, you may provide information such as your name, address, email address, date of birth, comments and testimonials.
Software Applications
- When using our software applications, you may grant permissions to access information from your device such as location and camera access to support functions you activate
- To use certain features, you will need to provide your vehicle identification number (VIN)

- When registering for training or educational opportunities, you may provide your name, contact information, and professional details such as certifications and resume
1.2 Information We Collect Automatically on our MBUSA Platform
Tracking Technologies
- We use cookies, pixel tags, and similar technologies on the MBUSA Platform to personalize your experience (including advertising and targeted content), analyze user trends, and improve our products, services, and platform
- Information collected through the MBUSA Platform may include your internet connection, device type and identifier, operating system, browser type, time spent on our sites, pages visited, geographic location, and other similar data
- You can configure your browser to refuse cookies, but this may limit functionality of the MBUSA Platform (for example, we may not be able to recognize your computer or device, and you may need to log in every time you visit)

Software Application Data
- When you use our software applications, we may automatically collect information about your device and usage patterns

1.3 Information We Collect from Third Parties
- We obtain information about the traffic and usage of the MBUSA Platform, your preferences, and your product and service history from third parties and service providers
- These parties and providers may place and access cookies, pixel tags, or similar technologies on your device to serve ads or other content personalized to your interests, which they infer from your browsing on the MBUSA Platform and other sites you have visited
- We encourage you to review the privacy statements of these third parties and service providers to understand their specific privacy practices
- MBUSA does not control third parties' collection, use, or sharing of your information. However, these third parties may provide you with ways to choose not to have your information collected or used in this way
- You can opt out of receiving targeted ads from members of the Network Advertising Initiative (NAI) on the NAI's site

Authorized Dealers
- We share information to facilitate purchases, service appointments, repairs, and warranty claims
- Dealers may contact you about your inquiries and provide information about products and services
Service Providers
- We engage companies to perform services on our behalf, including payment processing, customer support, data analysis, market research and marketing
- These providers are contractually obligated to protect your information and use it only for the purposes we specify

Residents of certain states, including California, Connecticut, Colorado, Delaware, Iowa, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia, are afforded certain privacy rights regarding our collection and use of your personal information. These rights may include:
- Right to Know and Access: You may request confirmation that we have collected your personal information and request details about what information we have collected, how we use it, and with whom we share it.
- Right to Data Portability: You may have the right to request that we provide a copy of your personal information in a portable and, to the extent technically feasible, readily usable format.
- Right to Deletion: You may request that we delete personal information we have collected about you, subject to certain exceptions.
- Right to Correction: You may request that we correct inaccurate personal information we maintain about you.
- Right to Opt-Out: You may opt out of the sale or sharing of your personal information to third parties and to opt out of the disclosure of your personal information to third parties for the purposes of targeted advertising.
- Right to Limit Use of Sensitive Personal Information: You may request that we limit the use of your sensitive personal information to specific purposes.
- Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.
- Right to Opt-Out of Profiling: You may have the right to opt out of profiling, as applicable, in furtherance of decisions that produce legal or similarly significant effects. We do not profile in a manner that would result in legal or similarly significant effects, but should you choose to opt-out, MBUSA will apply the opt-out to potential customer segmentation processing.
- Right to Confirm Third-Party Disclosures: You may have the right to request a list of the categories of third parties to whom we have disclosed your personal information, or specific third parties (other than natural persons) to whom we have disclosed your personal information. In these cases, we may provide a list of specific third parties or categories of third parties to whom we have disclosed any personal information.
- Right to Appeal: If we decline to act on your request, you may have the right to appeal our decision.
- Right to Revoke Consent: You may have the right to revoke consent you gave to our processing of your personal information.

Note that dealers are independent businesses and thus opt-outs from dealer-driven communications should be directed directly to those businesses.
Only you, or a person that you authorize to act on your behalf, may make a request related to your personal information. You may also make a request on behalf of your minor child. Where required by applicable law, your request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative of such person
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it
Except for requests to opt out of sales or sharing for targeted advertising, we will need to verify your identity by asking you for certain personal information, such as your name, contact details and vehicle specifics, to match with the information we have on file. The personal information that we use to verify your identity will not be used for any other purpose.

We do not "sell" or "share" sensitive personal information, and we do not knowingly "sell" or "share" personal information of minors under 16 years of age.

6. DATA RETENTION
We retain the personal information we collect for as long as reasonably necessary to achieve the purposes disclosed at the point of collection or in this Privacy Policy, unless a shorter retention period is required by law. The length of retention may vary depending upon factors such as:
- The existence of an ongoing relationship between you and us
- Recordkeeping or legal compliance requirements
- Supporting the operation and improvement of our business
- The need to resolve inquiries or complaints
For account information, we store this for as long as your account is active. If an account is deactivated, information is deleted on a schedule dependent on the type of information and respective requirements, such as billing, support, and audit purposes.
7. DEIDENTIFICATION
We may deidentify your personal information and disclose this deidentified information to others as permitted by applicable law. Where we deidentify information or use deidentified information, we will use the data only in deidentified form and will not attempt to reidentify that information.
8. CHILDREN'S PRIVACY
The MBUSA Platform is neither designed for nor targeted to children under the age of 13. If you are under the age of 13, do not provide your personal information through the MBUSA Platform. If you believe your child has impermissibly provided us with their personal information, please contact us so that we can identify and delete their information.
9. SECURITY
We implement commercially reasonable administrative, technical, and physical safeguards to protect personal information collected. No method of data transmission or storage is 100% secure, and we cannot guarantee absolute security.
10. ARTIFICIAL INTELLIGENCE
We may utilize artificial intelligence (AI) technologies to enhance our services, improve user experience, and for research and development purposes. We may notify you or otherwise disclose when you are interacting with AI in certain circumstances. In connection with these AI initiatives, we may process your information for the following purposes:
- Service Enhancement: AI may be used to personalize your experience, provide tailored recommendations, and improve the functionality of our platform and services
- Research and Innovation: We may use AI to conduct research, develop new features, and explore innovative applications of our technologies
- AI Training and Development: Your data may be used to train, test, and refine our AI models and algorithms, including but not limited to machine learning, natural language processing, and predictive analytics
- Security and Fraud Prevention: AI may be used to detect and prevent fraudulent activities, protect our systems, and ensure the security of your data
Data Minimization and Ethical Use: We are committed to using your data responsibly and ethically in our AI initiatives. We have developed our own AI Principles, which govern all our AI technologies. These include ethical and legal principles for the development and use of AI. The AI Principles necessitate responsible deployment, explainability, privacy protection as well as security and reliability. When using data for AI training and development, we implement appropriate data minimization techniques to limit the amount of data used to that which is necessary.
11. UPDATES TO THIS PRIVACY POLICY
MBUSA may update or change this Privacy Policy from time to time. The top of this Privacy Policy will indicate when it was most recently updated. Where changes to our privacy practices are material, we will notify you in accordance with applicable law.

Service and program-related communications can vary depending on the context of the service or program. You may request to withdraw from the applicable program or deactivate the relevant service in order to cease further related communications. We may, however, continue to send you information, such as notifications regarding recalls, warranty, and safety issues, to the extent required by applicable law or regulation.
